There are three ways to request access to records in the custody of the National Archives of Australia (‘the Archives’) – under the Archives Act 1983 (Cth) (‘Archives Act’), the Freedom of Information Act 1982 (Cth) (‘FOI Act’) or the Privacy Act 1988 (Cth) (‘Privacy Act’).
Under the Archives Act, requests can be made for archival records that are in the ‘open access period’, which currently includes records created up to including 1989. Under the Archives Act, all records are available to be accessed by the public once they enter the open access period unless they contain material that falls into certain exemption categories under section 33 of the Archives Act. Types of records which can be accessed under the Archives Act include records relating to family history such as immigration, citizenship and war service records, Cabinet records and notebooks and ASIO files. You can read more about access to archival records and the open access period in our fact sheet on access to records under the Archives Act. To access records which are not in the ‘open access period’ you will need to apply directly to the Australian Government agency which control the records.
Freedom of Information requests made to the National Archives of Australia are used to obtain access to:
· records in the open access period that are in the Archives’ custody that contain your personal information.
The Privacy Act 1988 (Cth) provides the right to request:
· access to records that contain your personal information;
· correction of your personal information because the information is inaccurate, out-of-date, incomplete, irrelevant or misleading.
Although the Privacy Act provides you with a right to make requests where your personal information is involved it will not apply in all situations. For example, you cannot use the Privacy Act to request records containing your personal information that are in the open access period.
