Request for access to documents under the Freedom of Information Act 1982
I refer to your
Freedom of Information Act (FOI Act) request dated and received on 30 March 2025, in which
you sought access to:
1. Licence application for Radiocommunications Licence 12699607/1.
2. Special events checklist related to Radiocommunications licence 12699607/1.
I have identified two documents that fall within the scope of your request.
I am writing to acknowledge your request, notify you of potential charges, consultation requirements under
sections 47F and 47G of the FOI Act and processing time. I also seek your consent to exclude personal
information from the scope of your request as described below.
Charges
The potential processing charges which the ACMA is entitled to charge are prescribed in the
Freedom of
Information (Charges) Regulations 2019.
These charges include:
➢ searching and retrieving ($15.00 per hour)
➢ making a decision on access ($20.00 per hour after the first five hours, which are for free)
➢ photocopying a written document (10 cents per page)
➢ making a copy of a written document other than a photocopy ($4.40 per page)
➢ postage or delivery (an amount not exceeding cost of postage or delivery)
➢ transcribing ($4.40 per page)
➢ supervising, if the applicant wishes to inspect ($6.25 per half an hour, or part thereof).
The ACMA will, in accordance with section 29 of the Act, advise you if you are liable to pay any charge and
provide a preliminary assessment of those charges.
Consultation requirements
The two documents within the scope of your request contain personal and business affairs information of
third persons and it is necessary to consult with those persons.
Documents containing personal information and business/professional affairs of third persons
Section 47F of the FOI Act relevantly provides:

A document is conditionally exempt if its disclosure under this Act would involve the
unreasonable disclosure of personal information about any person (including a deceased
person).
Section 47G of the FOI Act relevantly provides:
(1)
A document is conditionally exempt if its disclosure under this Act would disclose information
concerning a person in respect of his or her business or professional affairs[...] in a case in
which the disclosure of the information:
(a)
would, or could reasonably be expected to, unreasonably affect that person adversely on
respect of his or her lawful business or professional affairs[...]
The persons whose personal information and/or information concerning their business or professional
affairs appears in these documents may reasonably wish to contend that the information is exempt under
section 47F or 47G of the FOI Act. The ACMA is therefore required to consult to give them a reasonable
opportunity to make submissions in relation to the application of the exemption.
I will be writing to the relevant persons in relation to the documents that contain their personal
information and/or information concerning their business or professional affairs (subject to any consent
you give to exclude personal information described below).
Consent to exclude personal information from the scope of your request
The two documents within the scope of your request contain only minimal personal information, including:
the phone numbers, name, email address, job position and signature of an individual. You can exclude
personal information from the scope of your request if you do not seek access to this information.
If you chose this option, we would redact the personal information from the documents. This would reduce
processing time and any potential charges as we would only need consult on the business affairs
information in the documents (as described above).
Please confirm by return email if you consent to exclude this information from the scope for your request
by c.o.b.
14 April 2025 if possible and I will process your request on this basis.
Time for processing
The statutory timeframe for responding to your request under the FOI Act is generally 30 days,
commencing the day following the day on which the ACMA received the valid application (i.e. by in any
event by 29 April 2025).
However, to allow for third party consultation, this timeframe has been extended by an additional 30 days
(i.e. 29 May 2025) under subsection 15(6) of the FOI Act.
The decision on access will be made as soon as practical, but in any event by 29 May 2025 unless the
timeframe is further extended under the Act. You will be notified should there be a further extension.
