Dear Liz and Carly
 
Following on from discussions late last year in relation to the structure and organisational
needs/priorities, it is proposed to create a new position (Principal Director, Regulatory
Action) within the Regulatory Action division. The position would have a greater strategic and
operational focus, with responsibilities to address areas of high risk for the Agency, build
capability in areas that align with our strategic priorities and ensure consistency and expertise in the
management of our complex privacy matters.
 
This position will entail higher level responsibilities including:
a focus on all compliance initiatives beyond assessments
managing large team (10+ direct reports)
strategic role looking at matters spread across the division and to align with OAIC
priorities
targeting regulatory actions to address new and emerging harms
reforming the OAIC's approach to regulatory enforcement outcomes to achieve,
proportionate, effective and timely outcomes in accordance with defined regulatory
plans and budgets.
 
Structural/reporting considerations


Attached is the organisational chart for Regulatory Action. There are a few scenarios to
consider in terms of reporting:
1. PD reports to EGM, with all Directors reporting to the PD or
2. PD reports to EGM, with all Directors reporting to the PD other than; Director,
Enforcement Action and Director, Regulatory Coordination or
3. PD reports to EGM, with another combination of Directors reporting to the PD
Budgetary considerations
I have liaised with Simon and he confirms that there will be no issues with funding
this position, including keeping the Director, Compliance in place
may need to fund the new PD position in the longer term from the MYEFO funding
received, including flexibility with other budget and FTE allocation in the next
financial year
Recruitment considerations and next steps
it is proposed to temporarily place Heath Baker into the PD role given his skills,
capabilities and knowledge in this space
P&C will begin to prepare a formal Expression of Interest to be advertised across the
office in the next week
P&C will prepare an IFA for Heath for this position. P&C will send to Liz for review and
approval prior to sending to Heath
The IFA will also reference the need for the occupant to meet the required
performance measures in order to retain the IFA/remain in the position
