Dear Bayside City Council (NSW),
Crown Land Peter Depena Public Reserve RE1 has strict controls for what can be built and operate on it and how it can operate.
The location and council owned and leased out premises restaurant & kiosk operations have strict requirements which appear to have not be being met for a long time as listed in the Bayside councils still current adopted public 2010 Rockdale Cook Park Plan Of Management
https://www.crownland.nsw.gov.au/sites/default/files/2022-07/cook-park-pom-june-2010.pdf The Bayside Council ( previously Rockdale Council) has allowed a large restaurant and Cafe to be built on it gaining size over the years with operating hours from 7 am until 1 am daily (11 pm Sunday).
Please provide an online public link for the download of the following relating to the location, premises, operations, planned relocation, redevelopment, knockdown;
1. All past and current feasibility studies including that for F23/662 "Planning Proposal"
2. All past architect sought consultation feedback, summary and reports including that for the 24 October 2002 letter Trott Tench & Associates "Proposed Relocation of Le Beach Hut Restaurant and Kiosk, Peter Depena Public Reserve"
3. All historical and current Acoustic Reports / Noise Impact Assessments undertaken for the location, property and operations
4. All past and present traffic management, parking, appropriate patron numbers studies and reports done for the location and operations.
5. All past and present details relating to past Rockdale and Bayside council public tenders, responses and winners for the lease of the location council premises restaurant, kiosk and cafe which is on RE1, Public Reserve.
6. All details regarding council approved or rejected transfers of leases, subleases for the council premises.
7. Details of past fires at the council premises including dates, outcomes of investigations, costs incurred to repair, insurance claims. The council property has had Three major fires in the past reported in the major media including the Leader Newspaper title story " Fire is Suspicious"
8. A summary of all reported noise and other complaints for the council premises and operations ( as per the 2010 required Plan Of Management obligations)
9. Details of any police incident reports for the location and its council premises leased out restaurant / cafe operations, patrons behaviours on premises or in the adjacent park and car park and streets. ( as per the 2010 council plan of management for the location and operations requirement)
10. What surveys, studies, reports or consultations have taken place about Aboriginal Indigenous historical significance of this reserve park location has on which the large long trading hours council restaurant and cafe now operates and has any claims been made on the land by anyone or any association yet.
