Freedom of Information request — Notification of Decision
Thank you for your correspondence of 13 October 2024, in which you requested access to
documents held by the National Disability Insurance Agency (NDIA), under the
Freedom of
Information Act 1982 (FOI Act).
The purpose of this letter is to provide you with a decision on your request.
Scope of your request
You have requested access to the following documents:
“As per the Freedom of Information Act I am requesting access to documents within the
following scope:
- Al templates for recording an “activity” or “internal note” in an NDIS person account
Timeframes
In accordance with section 15(5)(b) of the FOI Act, a 30-day statutory period for processing
your request commenced from 14 October 2024. This 30-day period expired on 13
November 2024.
The 30-day period can be extended in a number of ways, including with your agreement. On
25 October 2024, your agreement was sought to a 30-day extension of time under section
15AA of the FOI Act. On the same date, you did not consent to an extension of time. As we
did not receive your consent, the original due date stands.
Processing period
We have been experiencing processing delays and were not able to provide you with our
decision by the due date. Consequently, we are deemed to have refused your application

under section 15AC of the FOI Act. I sincerely apologise for the delay in releasing this
decision to you.
We have continued processing your request. In the interests of not causing further delays, I
have decided not to apply for an extension to the processing period from the Office of the
Australian Information Commissioner (OAIC) under section 15AC of the FOI Act. Therefore,
internal review of this decision is not an option. However, your right to apply for an external
review with the Of ice of the Australian Information Commissioner remains protected. Details
are set out in
Attachment B to this letter.
Decision on access to documents
I am authorised to make decisions under section 23(1) of the FOI Act. My decision on your
request and the reasons for my decision are set out below.
The document was identified by searches conducted by the Service Guidance Branch. They
searched NDIA’s systems, using all reasonable search terms that could return documents
relevant to your request, and consulted with relevant NDIA staff who could be expected to be
able to identify documents within the scope of the request.
Two (2) documents have been identified which fall within the scope of your request.
I have decided to grant access to 1 document(s) in full.
In reaching my decision, I took the following into account:
· the nature and content of the document falling within the scope of your request
· the FOI Act
· consultation with relevant NDIA staff
· factors relevant to my assessment of whether or not disclosure would be in the
public interest

released under FOI 24/25-0368 as identified by you on 8 February 2025. This document is:
