Your Freedom of Information request – Third Party Consultation - LEX 78180
I refer to your request, outlined below and received by the Office of the
Hon Tanya Plibersek, Minister for the Environment and Water (Ministers
Office) on 10 September 2024 for access under the Freedom of Information
Act 1982 (FOI Act) to the following documents:
‘I am seeking copies of all written communication between the Minister /
her staff and the Environmental Defenders Office / people acting on their
behalf.
Please limit to the period between 1 December 2023 and 31 May 2024’
Third party consultation – documents affecting personal privacy and
business affairs
Your request covers documents which contain an individual’s personal
information as well as documents that contain information concerning the
business, commercial or financial affairs of an organisation. As such the
Ministers Office is required to undertake consultation before making a
decision on the release of those documents.
The consultation mechanism under sections 27 and 27A applies when an
agency considers an individual or their representative may wish to contend
that the requested documents are exempt for reasons of personal privacy
and/or because release would disclose trade secrets or commercially
valuable information or may adversely affect their business or financial
affairs. The Ministers Office will take into account any comments
received, however, the final decision on whether to grant access to the
documents requested rests with the decision maker in the Ministers Office.
Time limits for processing your request
Under section 15(6) of the FOI Act, the period for processing your request
has been extended by 30 days to allow the Ministers Office time to consult
with the relevant third parties.

details in response to public enquiries. Where such details are included
in the scope of a request, this may add to processing time and applicable
charges as it may be necessary to consider whether the details are exempt
under the FOI Act. On this basis, unless you tell us otherwise, we will
assume that these details are out of scope of your request and they will
be deleted under section 22 of the FOI Act.
