Freedom of Information (FOI) request – Decision
On 19 August 2024, the Department of Home Affairs (the Department) received a request for
access to documents under the
Freedom of Information Act 1982 (the FOI Act).
The purpose of this letter is to provide you with a decision on your request for access under the
FOI Act.

Scope of request
You have requested access to the following documents:
Under the FOI Act, please provide a copy of the brief titled “Regulation 2.25AB visa
grant consideration (Bridging (Removal Pending) (subclass 070) visa) for individuals
residing in the Australian community - Considered by the Community Protection Board
on 24 January 2024” sent to the Minister for Immigration’s office on dates between
29/01/2024 and 24/04/2024 with the PDR number: MS24-000268.
On 26 August 2024 you agreed to revise the scope of your request to the following documents:
Under the FOI Act, please provide the signed version of the brief titled “Regulation

individuals residing in the Australian community - Considered by the Community

In reaching my decision I referred to the following:
• the terms of your request
• the documents relevant to the request
• the FOI Act
• Guidelines published by the Office of the Information Commissioner under section 93A
of the FOI Act (the FOI Guidelines)
• advice from Departmental officers with responsibility for matters relating to the
documents to which you sought access

Documents in scope of request
The Department has undertaken reasonable searches for documents within the scope of your
request. The relevant business area has confirmed that the Department does not hold a signed
copy of Ministerial Submission MS24-000268.
Having regard to your request and the types of documents that may fall within the scope of your
request I am satisfied that the searches conducted were extremely thorough and all reasonable
steps have been taken to locate any document relevant to your request.
I am therefore satisfied that all reasonable steps have been taken to locate any documents
relevant to your request, and that the Department does not hold existing discrete documents that
contain the information you are seeking.

Decision
Section 24A of the FOI Act provides that the Department may refuse a request for access to a
document if all reasonable steps have been taken to find the document and the Department is
satisfied that the document does not exist.
I am satisfied that the Department has undertaken reasonable searches in relation to your
request and that no documents were in the possession of the Department on 19 August 2024
when your FOI request was received. As such, I am refusing your request based on the
application of section 24A of the FOI Act.
