Request for internal review of Freedom of Information decision 
I refer to your email sent to East Gippsland Shire Council (“Council”) on 4 September 2024 about 
the Council’s decision on your request for access to documents under the Freedom of Information 
Act 1982 (Vic) (“FOI Act”).   
 
Your email sought internal review and broadly raised the following as issues: 
  1.  The timeliness of Council’s actions and information provided about documents; 
2.  Consultations with third party businesses and whether this occurred; 
3.  The documents identified in relation to your request and to which you were granted 
access; and 
4.  Being granted the opportunity to inspect documents that are subject to copyright, rather 
provided with a copy. 
In relation to each issue raised, Council confirms that its FOI officers handled your request in 
accordance with the Victorian FOI Act and the Professional Standards developed by the Of ice of 
the Victorian Information Commissioner. 
 
Council is unable to act on your request for internal review.  As Council has made its decision, it 
has no power to further deal with your request.  It does not have power to conduct internal 
reviews under the Victorian FOI Act.   
 
While the Commonwealth Freedom of Information Act 1982 contains an internal review power, it 
does not apply to Council as Council is a Victorian body, not a Commonwealth one.  Information 
about your review rights and how to exercise them is set out in the decision letter.    
 
The decision letter also includes information about how to arrange access to the documents you 
sought.
