Hi Peter
I understand that Marc has been nominated as the decision maker. For your visibility, we have
received similar FOI requests in the past. At the time, Finance undertook Third Party Consultation
with .au Domain Administration Limited (auDA), the administrator of the .au country code Top
Level Domain (ccTLD). They advised that disclosure of a comprehensive list of all domain names
registered under the .gov.au second-level domain (2TLD) would not be appropriate. A copy of their
advice, subject to legal privilege, is attached.
Finance subsequently refused to release a list of domain names “as its disclosure would found an
action, by .au Domain Administration Ltd (auDA) and Identity Digital Australian Pty Ltd (Identity
Digital) (formerly known as Afilias Australia Pty Ltd) for breach of confidence.”  Copy of FOI 22/54

Good afternoon Peter,
 
A new Freedom of Information (FOI) request has been received by Finance and we require you to
nominate a decision maker and peer adviser to be responsible for making an access decision on
behalf of the Department of Finance.
 
We have sent this request to ICT Division as the recent requests that are similar were assigned to
the Governance and Procurement Branch, however if you believe this is more appropriate with the
Digital ID Taskforce Division we will forward to John Shepherd.
